ATLANTA (AP) — The charges against former President Donald Trump in the Georgia election interference case seek to criminalize political speech and advocacy conduct that the First Amendment protects, his lawyers argued in a court filing challenging the indictment. Fulton County Superior Court Judge Scott McAfee plans to hear arguments on that filing and on two pretrial motions filed by former Georgia Republican Party chair David Shafer during a hearing set for Thursday. Lawyers for Shafer argue that he acted legally when he and other state Republicans signed a certificate asserting that Trump won the 2020 presidential election in Georgia and declaring themselves the state’s “duly elected and qualified” electors. McAfee is forging ahead with the case even as Trump and other defendants have said they plan to seek a ruling from the Georgia Court of Appeals to disqualify District Attorney Fani Willis. The charges against him include impersonating a public officer, forgery, false statements and writings, and attempting to file false documents.

Only 4.4% of Georgia workers are union members, the eighth-lowest rate among states. The National Labor Relations Board, the federal agency overseeing union affairs, did not immediately respond Thursday to an email seeking comment. ATLANTA (AP) — A bill to require cash bail for 30 additional crimes is headed to Georgia Gov. The GOP-dominated House voted 97-69 for Senate Bill 63 on Monday, backing a measure that would erodes changes that Republican Gov. “This legislation will make it clear that Georgia is not going down the path of failure seen by other states and communities that have eliminated cash bail," Gaines said. It’s part of a push by Republicans nationwide to increase reliance on cash bail, even as some Democratic-led jurisdictions end cash bail entirely or dramatically restrict its use. Under the bill, bail would be required for a second or later misdemeanor offense of reckless driving or criminal trespass, as well as for any misdemeanor battery.

Still, a source familiar with the thinking inside the DA’s office told CNN they would be “mystified” if it succeeds in removing her. “I think a lot of what I’ve read is more of a distraction and not legally substantive,” James told CNN in a sit-down interview. I think it’s very unlikely that we’ll see any criminal action come out of that,” Kreis told CNN. ATLANTA (AP) — Lawyers for three Georgia Republicans, who falsely claimed that Donald Trump won the state and they were “duly elected and qualified” electors, are set to argue Wednesday that criminal charges against them should be moved from state to federal court. Shafer, Still and Latham have all indicated in court filings that they will not be present in court for the hearing. If their cases are moved to federal court, a jury would be drawn from a broader and potentially less Democratic pool than in Fulton County alone. Prosecutors allege that Shafer, Still, Latham — and the other Georgia Republicans who participated in that plan — “falsely impersonated” electors. They argued in court filings that “contingent electors” are not presidential electors — either the contingency is met and they become presidential electors or it is not met and the losing candidate's electors have no role.

Two of the people charged have filed speedy trial demands, and Judge Scott McAfee set their trial for Oct. 23. That could lead to multiple trials in the high-profile case happening simultaneously, creating security issues and “unavoidable burdens” on witnesses and victims, prosecutors argued. Five of the defendants are seeking to move their cases to federal court, and lawyers for Trump have said he may do the same. But prosecutors noted that the law explicitly allows a case to continue to move forward in a state court while the question of moving a case to federal court is pending. Since lawyers Kenneth Chesebro and Sidney Powell have both filed speedy trial demands, Fulton County Superior Court Judge Scott McAfee said their trial would begin Oct. 23, but he seemed skeptical of prosecutors’ arguments that all 19 defendants could be tried together that soon. The judge said Chesebro and Powell would be tried together starting on the Oct. 23 trial date already set for Chesebro to comply with their demands for a speedy trial. Four other defendants who are also seeking to move their cases to federal court have hearings set before Jones later this month. Whenever and wherever any trial in the case ultimately takes place, jury selection is likely to be a challenge. Jury selection in a racketeering and gang case brought last year by Willis began in January and is still ongoing.
